The application runs automatically in the background and will intelligently generate the route for the trips. These trips are available for view in our www.SimplyGPS.net website.
These terms and conditions (“Terms”) govern your access to and use of the Blackberry software application, the www.SimplyGPS.net website, any information, text, graphics, or other materials appearing on the Site, and collectively referred to as the “Service”. This Service is provided by GreenOwl Solutions Inc (“GreenOwl”). Your access to and use of the Service is expressly conditioned on your compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms.
Use of the SimplyGPS Service
Safety of our users is important to us. Our application is designed with no user interaction required while driving. Only use any control button of the application when you aren’t driving. Safe vehicle operation is the user’s responsibility.
PLEASE USE THE SIMPLY GPS SERVICE IN ACCORDANCE WITH ALL LAWS AND REGULATIONS, AND ONLY TO THE EXTENT THAT IT DOES NOT DISTRACT YOU FROM DRIVING. FOCUS ALL YOUR ATTENTION ON THE ROAD AND YOUR DRIVING.
We do not required any personal information to operate this service, except an email address in which you the user can use to log in to view the realtime location of the tracking device. Please read the Privacy Policy to describe how we use any personal information of yours which we collect, should you provide us with personal information for promotions and company updates.
We reserve the right to alter or discontinue the Service, in whole or in part, at any time in our sole discretion.
We reserve the right, at our discretion, to modify these Terms. We will inform You regarding such modifications by posting such latest changes on the Site. Your continued use of the Service following the posting of changes to these Terms means You accept those changes.
Limitation of Liability and Warranty
The Simply GPS services is provided “AS IS” and “AS AVAILABLE” and without warranties of any kind. The real-time location tracked, historical routes, and other content may not be current, accurate, or complete as one of the major factors is the accurate of the GPS signal of the BlackBerry device.
UNDER NO CIRCUMSTANCES SHALL GREENOWL, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, ASSIGNS OR AGENTS BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SIMPLYGPS SERVICE, INCLUDING WITHOUT LIMITATION, RESULTING FROM TRAFFIC ACCIDENTS, TRAFFIC FINES OR PENALTIES, INCORRECT ROUTES, OR OPERATION OF THE SIMPLYGPS SERVICE UNDER ANY CONDITIONS.

These Terms will be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
